Real Estate Transfer Tax for Town of Gardiner

REAL ESTATE TRANSFER TAX COLLECTED YEAR TO DATE 2023: Click here to view totals spreadsheet

Effective February 1, 2023, every person recording a conveyance of real property located in the Town of Gardiner, must at the same time file a Gardiner Transfer Tax Form with the Ulster County Clerk and pay the required amount of tax due, if any.

  Required:

    • Complete the Gardiner Transfer Tax Form, consulting the Town of Gardiner Local Law #5 of 2022.

    • For further information, visit the webpage of the Ulster County Clerk.

    • Enter $350,000 as the median residential sales price for Ulster County on Schedule B, Part I, Line 2. The median value is set every year by the County, and the updated cost will be published on the County site and the Town website.

    • When presenting a deed for recording, attach recorded Purchase Agreement or first and last page of said Agreement, if prior to February 1, 2023, and box M on Schedule B, Part II, Line 13 is checked.

    • Fees payable to the Ulster County Clerk: filing fee of $5.00, plus the amount of Town of Gardiner Transfer Tax that is due, if any.

    • Gardiner Transfer Tax Form must be completed when recording a conveyance of real property situated in the Town of Gardiner.

Pursuant to Section 1561 of Article 33-B of the New York Tax Law, the Town of Gardiner, Ulster County, New York, adopted Local Law 5 of 2022 on July 27, 2022, which local law was approved by referendum at the general election held on November 8, 2022, imposing a transfer tax at a rate of 1.25% on each conveyance of real property or interest therein within the Town of Gardiner. This transfer tax will go into effect on February 1, 2023.

The ballot for the November 8, 2022 election included a referendum on whether Gardiner will adopt a Community Preservation Fund (CPF) and it was approved. The CPF will provide the funding for priority preservation projects that are identified from the Community Preservation Plan (CPP) approved by the Town Board in July 2022.

In July 2022, the Town Board adopted three local laws which will enable town residents to vote on a referendum on the November 2022 ballot, to enact a 1.25% one time real estate transfer tax on sales above the County median price of $320,000.

The Community Preservation Plan was passed by the Town Board - but implementation of the Community Preservation Fund must be established by a public election in November.

This year the Town of Gardiner has created a Community Preservation Plan, with the goal of preserving our town's open space, natural habitats, scenic views, farmland & agricultural resources and recreational areas, as well as improving our climate resiliency.

Preserving these precious features of our town is critical to maintaining our community's character and a high quality of life for all residents of Gardiner.
